How Much Underinsured Coverage Do I Need?

0

philFrankelI constantly urge motorcyclists to look at and increase uninsured/underinsured (SUM) coverage. I recommend that you purchase the highest coverage your insurance company will sell, but how much do you really need?

As a reminder, uninsured coverage will pay you money if you are injured by the negligence of someone who has no insurance or who left the scene in a hit and run. Underinsured coverage will pay you an additional amount above the other car’s insurance coverage if they have less insurance coverage than you. (Continue Reading)

Why I didn’t see a motorcycle when making a left turn!

My worst nightmare could’ve become a reality. I was always careful to watch for motorcycles on the road ever since I got my license. As an attorney representing motorcyclists, I certainly don’t want to injure a motorcyclist.
Only two blocks from my house, I was stopped at a T intersection waiting to make a left turn. Because it is a T intersection, I only had to worry about traffic coming from my left and traffic coming from my right. Obviously, there could be no traffic coming in the opposite direction which made it easier to make the turn. (Continue Reading)

Who Struck Who First…

philFrankel…Does it Matter?

Insurance claim representatives sometimes argue that the motorcycle struck the car to show the motorcyclist is at fault or partially at fault. They say the motorcycle was the striking vehicle.
Frequently, motorcyclists who call me mention they hit the car and think that might be considered in determining fault against them. (Continue Reading)

Why Drivers Don’t See Motorcycles

0

philFrankelWhy Drivers Don’t See Motorcycles

The most common reason for motorcycle accidents is the driver’s failure to see the motorcycle, resulting in violating the motorcyclist’s legal right-of-way.  You might think the only reason drivers don’t see motorcycles is that they’re not looking but awareness of motorcycles is more than looking. Why Should I Buy Collision Damage Coverage?

0

philFrankelFrom the Desk of Phil Franckel

Collision damage coverage insures your motorcycle or car for the cost to repair your vehicle or replace it if it is totaled.  When you have collision coverage your own insurance company will pay for repairs to your motorcycle or car regardless of who is at fault for the accident. Many people who don’t have collision coverage are seeking to save the cost of the premium because their vehicle is not valuable enough to insure or because they don’t think they will be at fault for causing an accident and the other car’s insurance will pay. Doesn’t No Fault Mean I’m Not at Fault?

From the desk of Phil Franckel

philFrankel

We’ve been asked many times and there are many searches on our website for “If I’m on a motorcycle and get hit by a car doesn’t no-fault mean I’m not at fault?”

No, it doesn’t. Likewise, it does not mean that the car which hit your motorcycle is not at fault. No-Fault has nothing to do with whether or not you are considered at fault for causing an accident. (Continue Reading)
